做过水果电商，怀抱着大学生创业的心，长沙一高校大四学生小孙和同学合伙，与奶茶店老板刘女士签下转租合同，不料陷入了合同纠纷。近日，小孙被“请”出店铺，大门被上锁。刘女士认为小孙单方面违约，拒绝退还押金，校方称校内店铺禁止转租，将召开见面会维护学生权益。
昨日下午，小孙等人从门缝下面取出客人放入的留言纸条，店门已被上锁。
三人把学费赌上，然陷经营不善
小孙和同学是长沙某大学经济学院的学生，三人曾合伙做过电商，在学校里售卖水果类商品。大四开学期间，小孙尝试创业开一家实体商店。
“班主任老师和任课老师偶尔鼓励尝试着自己创业，本学期又设了创业培训班。”小孙称，在学校里发现一处新建的商场，“很多门店开张，装修也不错，附近商铺表示有一家奶茶店有意将店面交给别人来做。”小孙电话联系店长刘女士，之后双方签订《转租合同》，小孙得到该奶茶店一年的经营权，每月向刘顺桃缴纳租金11000元，按季度结算。“心想着未来的生活还挺有奔头。”小孙介绍。
“第一个月的生意还不错，后两个月营业额只能达到7000多元。”昨日下午1点半左右，在该校西园商场进门的第一个商铺，看到小孙经营的奶茶店，门店约30平方米，室内一片漆黑，水电被关停，大厅摆放着两个水桶，白纸散落在地面，玻璃门上装有两把锁。
小孙称，三人原本决定通过网上外卖来扭转奶茶店的业务量，却发现奶茶店竟未办理营业执照和卫生许可证。外卖无法进行，遇到工商所执法检查，三人便关门逃避检查，生意江河日下。
12月8日，一个季度时间到期，小孙三人无力支付房租费，刘女士以小孙违约为由终止合同，收回奶茶店并表示不予退还2万元押金。“我当时慌乱不已，押金是我们三人的学费凑合的，现在拖欠学费也没敢和家人说。”小孙表示。
无法退还押金，或走法律程序
小孙介绍，校内有多处门面是学生的创业项目，包括服装店和小吃店等。注意到商场门口一份管理规定，规定第十条表示禁止私自转租和转让，一经发现自行终止门面合同。
今年9月初，刘女士向学校租得该门店，租期三年，投入20余万做奶茶生意。她表示，允许小孙15天内处理店里的货物，根据合同扣除押金。“如果不行，就只能请律师。”
校方称商铺禁止转租于第三方
该校后勤处商贸中心一名王姓科长表示，为了规范经营，学校在合同书上明确禁止商铺转租，但该奶茶店属于特殊情况，刘女士至今未收到与校方的合同书。
针对该事，红网联动律师、中华全国律师协会会员娄治斌认为，刘女士和小孙之间签订的租赁合同在法律中属于常见现象，合同具有法律效应。合同约定孙同学需要租满一年，否则不予退还押金，现在小孙等人的行为违反合同，刘女士按照约定拒绝退还押金是合理行为。娄治斌说，若采取法律手段，小孙等人将处于被动地位。
不过事件发生在高校范围内，王科长称，刘女士的行为已违反学校规定，将阻止小孙等人继续转租并安排三方见面会，介入该事件进行协商。
