翻译过来:没有人可以不经法律的正当程序,而被剥夺生命、自由与财产;私人财产在没有得到正当补偿的情况下,不得被征收以供公共使用。
这就衍生出两层意思了:
1、私人财产为了公共政策需要可以被征收。
2、经过法律的正当程序,是可以剥夺个人财产的。
第一点不多展开,最高法院围绕到底什么是公共使用,是按照实际使用情况来看,还是以背后的目的来看,有一连串交锋。从这一系列交锋可以看出,私人财产是可以被征用的,法律所关心的是何种理由能被接受。
第二点的话,至于什么是正当程序,有很多辩经的空间。比如 Bill of Attainder(国内有人翻译成「褫夺公权」,私以为不太准确,所以直接用原文)式的立法是不行的,根据分三权分立的制度设计,立法者不得直接专门制定一条法律来不经审判地惩罚一个人,这样做程序不合法。
说到这里,灰色地带就来了:
根据宪法所确立的原则,美国国会不得直接通过一部法案,规定只要你的名字叫 John Son、Social Security 号码是多少多少,就要罚款一百刀,立即去市政厅交钱,没有听证或审判的机会。因为这就是抢了司法部门的生意,直接立法来惩罚个人。
但是,立法者可以说,我不是要跟 John Son 过不去,是要立法打击 3 月 15 日晚上九点三十七分在 Twin-fairy Bridge 匝道上逆行的人,不针对具体的人,只是针对一类人进行管理而已。
这就有了辩经的余地 -- 律师们就可以开始掰扯,看看这条立法是不是已经量身定做到定点打击某个人的程度而违背了正当程序。
再者,立法者也给行政部门留下了一定的灵活性,在战争这样的国家紧急状态中中,授予总统总指挥官的权力(Commander in Chief Power)。从特朗普任期开始,紧急状态渐渐成为常态,为了打击美墨边境的偷渡问题,可以通过“紧急状态”拨款修墙;为了应对疫情紧急状态,可以通过行政命令来实质上推翻奥巴马医改;为了国家安全的紧急状态,可以直接通过总统令制裁外国公司。这种行为,反正行政部门是宣称自己遵循了正当程序的。
归根结底,我们还是要准确理解,私人财产神圣不可侵犯的这句话,神圣不可侵犯,不是绝对不可侵犯 -- 它是我们最宝贵的权利啊,得有一个分量十足的、正当的理由。
